Terms of Service

1. Acceptance of Terms

These Terms govern Progresio accounts and subscriptions supplied by MetaCode Michał Gawron, ul. Jesionowa 45/56, 50-504 Wrocław, Poland, NIP 8961580439, REGON 381052237, VAT EU PL8961580439 (“MetaCode”, “we” or “us”). Contact: [email protected]. By creating an account, you conclude a contract with us and accept these Terms. Mandatory consumer rights remain unaffected.

2. Service Description

Progresio is a software service for workout and fitness-progress tracking. Depending on the selected plan and role, it provides:

  • Exercise library
  • Workout logging
  • Progress and verified achievement tracking
  • Workout statistics and analytics
  • Premium, trainer and studio software features (paid)

We sell access to the software only. Trainers and studios arrange and supply any coaching independently and are not our employees or agents. Progresio does not broker or collect payment for trainer-client coaching contracts.

3. User Account

You must be at least 18 years old and legally capable of concluding the contract. To use full functionality, you must create an account. You are responsible for:

  • Keeping your password confidential
  • All activities performed on your account
  • Providing truthful and current data

Creating accounts for third parties without their authorization is prohibited. You must promptly update your details and notify us of unauthorized account use. The contract is concluded when we confirm registration or activate the account. Subscription contracts are additionally concluded when Stripe confirms the order. We provide confirmation electronically.

4. User Responsibility

By using Progresio, you agree that you will:

  • Use the application as intended
  • Not upload unlawful, infringing, abusive or misleading content
  • Not attempt to compromise application security
  • Respect other users, confidentiality and trainer-client access boundaries
  • Consult a physician before starting any exercise program: particularly if you have symptoms, an injury or a medical condition
  • Perform exercises at your own responsibility and risk

5. Limitation of Liability

Progresio provides organizational and tracking tools, not medical diagnosis, treatment or individualized medical advice. Exercise involves inherent risk. Stop and seek qualified advice if you experience concerning symptoms.

  • We are responsible for failure to perform the digital service and for damage where required by applicable law
  • Nothing in these Terms excludes liability that cannot legally be excluded, including liability for intentional misconduct, gross negligence, personal injury caused by us, or mandatory consumer remedies
  • For business users only, to the extent legally permitted, we are not liable for indirect loss, lost profit or events beyond our reasonable control, and total contractual liability is limited to fees paid for the affected service during the preceding 12 months

You are responsible for deciding whether exercises and trainer instructions are suitable for you. We are not responsible for independent trainers' or studios' coaching acts, but this does not limit rights arising from our own software service.

6. Premium Features and Payments

We offer free and paid subscription plans. The exact plan features, total VAT-inclusive price, currency, billing interval, trial (if any), minimum duration and renewal terms displayed immediately before checkout form part of your order. If checkout information conflicts with these general Terms, the checkout information controls for that order.

  • Free plan: basic workout tracking features
  • Paid plans: the personal, trainer or studio features and capacity shown before purchase

Payments:

  • Stripe processes payment and may apply authentication, tax and fraud controls
  • A subscription renews automatically for the billing interval shown at checkout until cancelled
  • You may cancel future renewal at any time through account settings and the Stripe billing portal; cancellation normally takes effect at the end of the current paid period
  • After cancellation, Premium access remains until the end of billing period
  • Price changes apply no earlier than a future renewal after reasonable advance notice; you may cancel before they take effect

Consumers have the statutory 14-day right of withdrawal described below. Cancellation of renewal is different from withdrawal. Refunds outside statutory rights are not guaranteed unless checkout or a separate written offer says otherwise. Promotion conditions shown with an offer apply in addition to these Terms.

7. Intellectual Property

The application, software, trademarks, interface and provider content are owned by us or our licensors. During the contract, we grant you a limited, non-exclusive, non-transferable right to use Progresio for its intended purpose. You may not reverse engineer, resell, scrape, disrupt or misuse the service except where mandatory law permits it.

You retain rights in content you submit. You grant us a worldwide, non-exclusive, royalty-free license to host, reproduce, transmit and display it only as needed to operate, secure and improve Progresio and to follow your sharing choices. You confirm that you may lawfully submit the content and remain responsible for it.

9. Account Suspension or Deletion

We may suspend or terminate an account for a material or repeated breach, unlawful use, security threat, non-payment, or where required by law. Where appropriate, we will provide notice and an opportunity to remedy the breach. Consumers retain mandatory remedies and access to data required by law.

You may delete your account in profile settings or contact us. Account deletion is not the same as statutory withdrawal. Cancel an active subscription through the billing portal before deleting the account. We will stop future billing following valid cancellation or withdrawal, subject to amounts lawfully due. Export data you wish to keep before deletion.

10. Changes to Terms

We may change these Terms for a valid reason, including changes to law, security, technology, service functionality or our business, provided the change is proportionate. We will inform users clearly and on a durable medium where required. A material change will not retroactively alter a paid period. Where law gives you a right to terminate because of a change, we will explain how and when to exercise it. Mere continued use does not waive mandatory consent or termination rights.

11. Governing Law

Polish law governs these Terms. If you are a consumer habitually resident in another country, this choice does not deprive you of mandatory protections of that country. Consumers may bring proceedings before courts available under applicable EU and national jurisdiction rules. The courts competent for our registered office apply only to disputes with business users where legally permitted.

12. Contact

Questions and complaints may be submitted electronically. Describe the issue, account email, requested resolution and relevant evidence. We will acknowledge and respond within the period required by law and, for consumer complaints, normally within 14 days.

13. Digital Service Conformity, Updates and Availability

We supply Progresio in conformity with the contract, including the described functionality, compatibility, continuity and security, and provide updates, including security updates, required to keep it in conformity. The service requires a supported modern browser, internet access for synchronization, and a compatible device. Offline functionality is limited and unsynchronized changes may require later connectivity.

We may perform maintenance and change non-essential features. If a consumer digital service lacks conformity, statutory remedies may include bringing it into conformity, a proportionate price reduction or termination under applicable law. Report problems promptly and cooperate reasonably in diagnosis. These rights are not limited by warranty disclaimers.

14. Consumer Right of Withdrawal

If you are an EU consumer, you may withdraw from a distance subscription contract without giving a reason within 14 days from its conclusion. To exercise the right, send an unequivocal statement to MetaCode Michał Gawron, ul. Jesionowa 45/56, 50-504 Wrocław, Poland, or [email protected] before the deadline. You may use the model wording below, but it is not mandatory.

Model withdrawal statement: I hereby give notice that I withdraw from my contract for the Progresio subscription concluded on [date]. Consumer name: [name]. Consumer address: [address]. Account email: [email]. Date: [date]. Signature (only if sent on paper).

Paid access normally begins immediately. Where you expressly request performance during the withdrawal period and then withdraw, you may owe a proportionate amount for the service supplied up to withdrawal, but only where applicable legal requirements were met. We will reimburse sums due without undue delay and no later than 14 days after receiving the withdrawal notice, using the original payment method unless agreed otherwise. The withdrawal right and any exception are governed by mandatory law.

15. Consumer Dispute Resolution

Consumers may obtain free assistance from a municipal or district consumer ombudsman, the Polish Trade Inspection, or consumer organizations. The competent Provincial Inspectorate of Trade Inspection may operate consumer ADR proceedings. We do not make a general advance commitment to participate in ADR unless participation is required by law; after an unresolved complaint, we will provide the information required by law and state whether we agree to the relevant proceeding.

The former EU Online Dispute Resolution platform has been discontinued and is not available for new disputes.
